General Partner with Dementia Was Still a General Partner Able to
Bind the Partnership
In Mary Hubert Limited Partnership
v. Hasselbring, 2018 Il. App.(3d) 160623-U 2018 WL 298293 (3rd
Dist., Ill App. Jan. 3, 2018), the court found that an elderly general partner,
suffering from dementia, had not been dissociated as a general partner and
therefore still had the ability to bind to the partnership. On other grounds,
however, the lease that was the subject of the litigation was held
unenforceable on grounds of unconscionability.
