Distinguishing
Business Entities from Their Owners
At the upcoming SEALS conference
being held in Fort Lauderdale Florida, I will be joining a panel of law professors
to discuss issues of corporate personhood and the related separation of
business entities from their owners.
Cast originally to explore the application
of the Masterpiece Cakeshop decision,
which ultimately was resolved on a separate legal issue (HERE IS A LINK to my review of that
non-decision), the issues remain relevant in any number of cases working
through the courts whereby other participants in the wedding industry including
florists and photographers assert the right to not provide services to same-sex
couples. Other cases, such as those involving a refusal to rent Airbnb or
long-term care facilities to same-sex couples likewise will be at issue.
