Yesterday, in response to my review of the VanWinkle v. Walker decision, Professor Joshua Fershee of West
Virginia law, on the Business Law Prof Blog, posted some additional thoughts.
Essentially, in Should You Ever Pierce
the LLC Veil to Let a Member Recover? Probably Not, he suggests that it is
not appropriate to apply piercing analysis on an inter-se creditor dispute such
as that at issue in the VanWinkle
