An Innovative Use
of LLCs
A story in the L.A. Times, Immigrants Lacking Papers Work Legally – As Their Own Bosses (Sept.
14, 2013) reports on the use of limited liability companies by persons who, lacking
legal status and the ability to be employed in the U.S., instead organize an
LLC. That LLC agrees to perform services
on behalf of what would otherwise the employer. In turn, the illegal immigrant, as a member
of the LLC, does the work on its behalf.
In the example cited in the article, Carla Chavarria cannot be directly
employed to render the graphics design and branding services she provides. However, it is legal for her LLC to be hired
to do the same work.
